Extradition/ European Arrest Warrants/ Mutual Legal Assistance

Whether you are facing a European Arrest Warrant or extradition under other provisions, our Extradition Team has the expertise to guide you through this difficult experience, give clear and accessible advice and to protect your interests.

Extradition is the process by which one state seeks the transfer of a person in order to stand trial or serve a sentence in the requesting country. Since the enactment of the European Arrest Warrant Act in 2003, an increasing number of extradition requests have been made to the Irish state from EU Member States. KOD Lyons have dealt with many such requests under this legislation, as well as with requests from non-EU countries pursuant to the existing 1965 Extradition Act.

Being subjected to an extradition request can be an extremely traumatic experience. Defendants often have little or no warning that an application will be made and the initial stages of the process can be daunting. In many circumstances, the law often allows only limited grounds to oppose and defeat the extradition request. It is therefore essential to access good advice at an early stage.

Our Extradition Team has the expertise to guide you through this difficult experience, give clear and accessible advice and to strongly promote and protect your interests.

We can also advise on the Interpol system, including Interpol Red Notices, and on all aspects of mutual legal assistance in criminal matters.
